HOW TO ORDER: We suggest you pre-book your poultry order in advance to ensure the largest breed availability. Orders must be placed via phone, and soon our website: www.ThePoultryHatchery.com. 

MINIMUM ORDER:We have set minimums per New York State Ag & Markets Law 26a and humane shipping standards to ensure the birds stay warm and prevent them from shifting around throughout the shipping process. Please note that each type of fowl ordered has their own minimums, and different types of fowl CANNOT usually be combined to meet those minimums. However, you CAN usually combine different breeds within each type of fowl to meet the minimum requirements unless specified. See order minimum page here.

HOW WILL THE BIRDS ARRIVE: Your order will be shipped United States Postal Service Priority 1-2 Day delivery. The birds will be stopped at your local post office closest to your shipping address you provided, the chicks will NOT be delivered to your store, they must be picked up from your local post office once they arrive. 

PICK UP ORDERS: Your pick-up date will be confirmed via phone and or email. You must bring a clean container or box with just a single layer of paper towels. We request no pine shavings, no straw, no newspaper. Please call prior to leaving your location to verify the hatch is ready for pick up to avoid wasted time of an unsuccessful hatch or delays. 

SMALL ORDER CHARGE (SOC): If you order less than 100 chicks/chickens you will notice on your invoice a ‘small order charge’. This fee is $7.00 per order. In larger orders of over 100+ chick/chickens you will not be charged this fee. 

SPECIFIC BREED CALL (SBC): We allow you to mix and match your breed combinations without restrictions (1 of these, 4 of that, 2 of this); although it can be very time-consuming depending on the mixture. You will be charged $1.00 per breed, per gender. Example: 1 Barred Plymouth Rock Female, 1 Black Australorp Female; you will be charged $1.00 X 2 Birds = $2.00 charge. If you need further explanation; please ask. 

HATCHING DATES: We do our best to decide your hatch date; although we are dealing with live poultry and counting our chickens before they hatch! Your hatch dates are approximate and can change with and/or without notice; although we do our best to let you know of such changes. Please call your local post office to let them know you are receiving a live delivery of chicks on your specified delivery date and to let you know when they arrive. If your chicks did not arrive on the schedule date, please call your post office first to see if they receive an express truck or 2nd delivery, then call us so we help speed up the process. 

ASSORTMENT (HATCHERY CHOICE): Assortments will be The Poultry Hatchery’s choice of breeds available after specific breed orders have been filled. Assortments include breeds hatched on that specific day and can vary each hatch date. Every attempt will be made to give the best assortment possible, but there is no guarantee. 

POULTRY SEXING GUARANTEE* 90%: We guarantee on a 100-paid pullet order that you will receive at least 90 pullets (assuming all chicks survived to be counted). If we make an error and we did not live up to our stated guarantee, we will refund the pullet purchase price on under 90%. In other words, if you have over 10% that are roosters of your pullet order we should be able to refund at pullet price over the 10%. Claims must be sent directly to us when chicks are not more than 8 weeks old, no exceptions. We have one of the best rated and multiple gender selecting methods in the industry, however, still it is only about 90% accurate. We do not have any guarantees on percentages on male or females for assorted chicks or straight run chicks. 

GUARANTEE: We guarantee 100% livery delivery of poultry paid for. Our poultry is under strict bio-security and under the supervision of New York State AG & Markets National Poultry Improvement Program (NPIP). Any losses should be reported at once to note your account. If order loss if greater than the shipping minimum, [varies depending on weather and breed] we will reship one (1) time at no charge. If order cannot be sent safely or meet the required minimums, credit adjustments will be made. Credits can take up to 1-2 weeks for processing. 

DECLINED CREDIT CARD FEE: If your credit card payment method has been declined by our banking institution you will be charged $3.00 per occurrence. Please ensure at the time of order the funds are available for withdrawal and you have the correct credit information. 

REFUNDS, DEPOSITS, PAYMENTS: Deposits are not refundable, if you decide to cancel your order see cancellation fee and refund below. Payments of invoices are due at the time of booking in full. 

ORDER CHANGES: Once an order has been placed and billed any additional/subtractions (changes) to the existing order will incur a $5.00 change order fee. Constant changes need added book keeping and causes errors. Please send only completed orders to avoid charges. 

CANCELED ORDER FEE (RESTOCKING FEE): Any orders place and then canceled will have 20% of the total price deducted from the total purchase of the invoice. The difference refunded by check if paid by check and if paid by credit will have the credit card credited back at the difference. Rational for the fee: Orders paid for/booked are taken off the market for sale and are marked sold and we potentially could have a lost opportunity for a buyer if canceled. Canceled orders create book keeping and labor cost to process the canceled order, labor to recalculate deletions and adding back on the sell sheets, along with postage or credit card fees to process credits. Our chicks pricing is not formulated for canceled order cost. We do make exceptions for the 20% fee for emergencies and will move a ship date to another date; however, every effort should be made to be prepared to receive your chicks on your given date. Refunds are processed ASAP, but on busy rare occasions can take up to 3 weeks to be completed. It is customary practice for customers to order their poultry 2-8 weeks in advance of the time they would like them delivered. Because live new chicks become perishable the day they hatch, it is necessary to have them all sold well before their hatch date. Your confirmation notice will give you your hatch date. You should be very flexible around your hatch date, so you can take your birds at once to your brooder to be warmed up, so they will go to eating and drinking. CREDIT CARD CHARGE BACK POLICY: Charge backs will be prosecuted as fraud under News York State Law. A$50.00 fee will be added for a charge back, and account will be forward to our collection department and our attorney. We will be happy to resolve any issues you may have to avoid using this clause in our company policy, although we must be notified prior to starting the charge back. RETURNED CHECK CHARGE: The Poultry Hatchery will charge $50.00 for any check returned by a financial institution to The Poultry Hatchery. HEALTH CONCERNS: Live poultry can be a source of potentially harmful microorganisms; therefore, precautions must be taken when handling and caring for them, to prevent fecal/oral transmission among people. Adults must supervise children when they handle poultry to make sure they do not put their hands or fingers into their mouths. Do not keep baby poultry in the family living space. Always wash your hands with soap and water after handling poultry. 

**IMPORANT**: Upon arrival of your baby poultry, read "TIPS FOR TAKING CARE OF BABY POULTRY" which is available to you on our website under "E-Learning". Seller warrants that the poultry described in the order will be in good condition, as far as can reasonably be determined, at the time of delivery by Seller, who has exercised flock control, egg selection, production, and handling methods (including established sanitary and disease control standards) generally accepted in the industry. It is understood, agreed, and considered reasonable that THERE ARE NO WARRANTIES, EXPRESSED OR IMPLIED, WITH RESPECT TO THE POULTRY THAN THOSE SPECIFICALLY STATED IN THIS AGREEMENT, AND SELLER SPECIFICALLY DISCLAIMS ANY WARRANT OF MERCHANTABILITY OR FITNESS OF THE POULTRY. WE RESEVE THE RIGHT TO SUBSTITUTE ALL ORDERS WITH OR WITHOUT NOTICE; STRAIGHT RUN MALES MAY BE ADDED TO COMPLETE YOUR ORDER! Rest assured, we will do our best to move your hatch date or do separate pick up and/or ship dates to complete your order, although we must add this clause to our company policy. The seller's liability for any reason whatsoever shall be limited to the amount paid for the goods or services claimed to be defective, and that in no event shall Seller be held liable for any consequential or incidental damages. By acceptance of the poultry hatchery, the Buyer acknowledges that the limitations and disclaimers here set forth are conditions of the sale and constitute the entire agreement between the parties regarding warranty or other liabilities and the remedy therefore.
